The City Council of the City of Watauga, Texas convened in pre-council at 6:30 p.m. and in regular session at 6:38 p.m. with the following members present:

1. Monthly Financial Report, Scott Neils, Director of Finance – Expenses and revenues for all funds from January 1 through January 31, 2009.
Director of Finance Scott Neils gave the financial report.
2. Minutes from Various Boards and Commissions
These were provided in the packet.
There was no discussion held.
Karin Newell thanked the Council for their partnership with Artsnet and the Masterworks Concert Series. She commended the city staff for all their support.

1. Presentation by CWD on Solid Waste Collection Service for the Past Year
Greg Roemer with CWD gave a power point presentation on the Solid Waste Collection Service for 2008.
2. Presentation of the 2007-2008 Comprehensive Annual Financial Report
Brad Jay, CPA with Weaver and Tidwell, gave the audit presentation.

1. City Council acceptance of the Comprehensive Annual Financial Report for the Fiscal Year Ending September 30, 2008
Council Member Steele made a motion to accept the Comprehensive Annual Financial Report for the Fiscal Year ending September 30, 2008. Council Member Koontz seconded the motion, which passed as follows:

2. Discussion and action on a proposed Resolution supporting creation of a Local Option Transportation District and Supporting County Local Option by voter approval for funding option and projects
Tarrant County Commissioner Gary Fickes addressed the City Council. Commissioner Fickes asked the Council to approve the proposed Resolution in support of creating a Local Option Transportation District and a Local Option by voter approval for funding transportation projects. Commissioner Fickes explained that the Resolution urges the 81st Texas Legislature to allow citizens the option, county by county, to vote for transportation projects and funding.
After discussion, Council Member Griffin made a motion to approve the proposed Resolution supporting creation of a Local Option Transportation District and Supporting County Local Option by voter approval for funding option and projects. The motion was seconded by Council Member Steele and passed as follows:

A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF WATAUGA, TEXAS SUPPORTING CREATION OF A LOCAL OPTION TRANSPORTATION DISTRICT AND SUPPORTING COUNTY LOCAL OPTION APPROVAL BY VOTERS TO CONSIDER FUNDING OPTIONS AND PROJECTS
3. Discussion and action to
approve an Ordinance amending Chapter 6, Article 6.300, paragraph (f) (1) of
the City of Watauga Code of Ordinances establishing procedures for notifying a
landowner or occupant for failure to comply with this article prior to the City
undertaking necessary improvements to bring the property into compliance
City Attorney Mark Daniel noted that an amendment was needed to the Ordinance requiring a “certified receipt requested” to the notification process.
Council Member Koontz made a motion to approve the Ordinance amending Chapter 6, Article 6.300, paragraph (f) (1) of the City of Watauga Code of Ordinances establishing procedures for notifying a landowner or occupant for failure to comply with this article prior to the City undertaking necessary improvements to bring the property into compliance with the amendment as stated by the City Attorney. The motion was seconded by Council Member Griffin and passed as follows:

AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF WATAUGA, TEXAS AMENDING CHAPTER 6, HEALTH AND SANITATION, ARTICLE 6.300, PARAGRAPH (f) (1) OF THE CITY OF WATAUGA CODE OF ORDINANCES ESTABLISHING PROCEDURES FOR NOTIFYING A LANDOWNER OR OCCUPANT OF FAILURE TO COMPLY WITH THIS ARTICLE PRIOR TO THE CITY UNDERTAKING THE NECESSARY IMPROVEMENTS TO BRING THE PROPERTY INTO COMPLIANCE; PROVIDING THAT ALL ORDINANCES IN CONFLICT HEREWITH ARE HEREBY REPEALED TO THE EXTENT THAT THEY ARE IN CONFLICT; PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE

Council Member Koontz made a motion to approve the Ordinance amending Chapter 12, Article 12.700, Section 12.701 and Section 12.703, paragraph (a) and paragraph (b) of the City of Watauga Code of Ordinances establishing Abatement and Removal Procedures of Inoperative Vehicles. The motion was seconded by Council Member Steele and passed as follows:
