Texas House Bill 61 (Move Over Statute) takes effect on September 1, 2019. The act amends the Texas Transportation Code section 545.157 commonly known as the 'Move Over Act,' which took effect on September 1, 2003.
The amendments still require that motorist move out of the lane closest to police, fire, emergency and TxDot vehicles when possible or to reduce their speed to 20 miles per hour below the posted limit. If the road does not offer multiple lanes, the driver must slow down.
The amendments add additional requirements to move over for vehicles that are a stationary authorized emergency vehicle using visual signals, tow trucks with visual signals, vehicles used by/for a utility provider using visual signals, a stationary vehicle used exclusively to transport municipal waste, highway maintenance or construction vehicles including sweepers and strippers and other road construction machines such as motor graders, road rollers, excavators, tractors, pneumatic tire equipment and movers.
